Terms of Use
Read this first: Fitzz is not medical advice
Fitzz is a training app, not a doctor, physiotherapist or personal trainer. Nothing in it is medical advice. Talk to a doctor before starting or changing an exercise programme, especially if you have a health condition, an injury, are pregnant, or have not exercised for a while. You exercise at your own risk. If you feel pain, dizziness, shortness of breath or unwell in any way, stop immediately and seek medical help. The full clause is section 4.
1. Who you are contracting with
These Terms of Use (the "Terms") are an agreement between you and Fitzz, the operator of the Fitzz app and the website fitzzapp.com ("Fitzz", "we", "us").
support@fitzzapp.com
How we handle your personal data is described in our Privacy Policy, which you can open from the same place in the app where you found these Terms, or at fitzzapp.com/privacy-policy. The Privacy Policy forms part of these Terms.
↑ Contents2. Acceptance, eligibility and age
By creating an account or using Fitzz you accept these Terms. If you do not accept them, do not use Fitzz.
You must be at least 13 years old to use Fitzz. If you are under 18, you confirm that a parent or guardian has read these Terms and the Privacy Policy, agrees to you using Fitzz, gives on your behalf any consent those documents ask for, and takes responsibility for your use of it. The age rating shown in the app stores describes the app's content, not who may use the service.
You must not use Fitzz if the law of your country prohibits you from doing so or from entering into this agreement.
↑ Contents3. What Fitzz is
Fitzz is a strength-training app. It offers workout programs and a library of exercises with demonstration videos, lets you build your own workouts, log sets, reps and weights, tracks personal records, and shows you how trained and recovered each muscle group is. The workouts and suggestions Fitzz shows you are generated automatically from the profile you fill in (your goals, experience, schedule, equipment and body areas to avoid) and from the training you log. They are general fitness content computed from what you tell us, not an individual assessment of you by a qualified professional.
Fitzz is for your personal, non-commercial use. Some features require a paid subscription (section 6). We may add, change or remove features, programs and exercises over time (section 11).
↑ Contents4. Medical and safety disclaimer
Fitzz does not provide medical advice, diagnosis or treatment and is not a substitute for a doctor, physiotherapist, dietitian or personal trainer. Nothing in the app, on the website or in any message from us is medical advice or a professional assessment of your fitness to exercise.
Consult a doctor before you start using Fitzz or change how you train, and follow their advice over anything Fitzz shows you, particularly if you have a heart condition, high blood pressure, a joint, bone or muscle injury, are pregnant or recently gave birth, have any other medical condition, take medication that affects exercise, or have not exercised regularly for some time.
You exercise at your own risk. Physical training carries an inherent risk of injury, and in rare cases of serious injury or death. You are responsible for choosing exercises and loads you can perform safely, for using equipment correctly and for training in a safe environment. Fitzz cannot see how you move, what condition you are in or what equipment you are using.
Stop immediately if you feel pain, faintness, dizziness, chest pain or pressure, shortness of breath beyond normal exertion, or unwell in any way, and seek medical help. Never work through pain because a workout says to continue.
The recovery and readiness figures Fitzz shows are estimates computed from the training you log. They are not a measurement of your body and must not be relied on to decide whether it is safe to train. Calorie figures are rough estimates. Results vary from person to person and we make no promise about the results you will achieve.
5. Your account
- Give us accurate information and keep it up to date. Fitzz builds workouts from what you enter; wrong information means unsuitable workouts.
- Keep your password confidential and do not share your account. You are responsible for everything done through your account until you tell us it has been compromised.
- If you sign in with Apple or Google, their terms also apply to that sign-in, and you are responsible for keeping that account secure.
- You may have one account. Creating accounts to obtain repeated free trials is a breach of these Terms.
- You can delete your account at any time in Profile › Account › Delete account, or via fitzzapp.com/DeleteAccount. Deleting your account does not cancel a store subscription (section 6).
6. Subscriptions, trials and renewals
Fitzz Premium is a paid subscription, available as a monthly or a yearly plan, that unlocks the features marked as Premium in the app. It is sold through the Apple App Store on iOS and Google Play on Android, and our subscription records are managed by RevenueCat. The price is shown in the store before you buy and may differ by country and currency.
- Free trial. New subscribers may be offered a 7-day free trial. If you do not cancel before the trial ends, the store charges you for the first subscription period. A trial is offered once per store account.
- Automatic renewal. Subscriptions renew automatically at the end of each period, at the then-current price, until you cancel. The store charges your payment method up to 24 hours before the period ends.
- Cancelling. Cancel any time in your App Store or Google Play account settings (on iOS: Settings › your name › Subscriptions; on Android: Play Store › Profile › Payments & subscriptions). Fitzz cannot cancel a subscription for you, and deleting your Fitzz account or the app does not cancel it. Cancellation takes effect at the end of the current period; you keep Premium until then.
- Refunds. Payments are taken by Apple or Google under their terms, and refunds are theirs to decide. Request a refund from Apple (reportaproblem.apple.com) or from Google Play. Where the law of your country gives you a right to a refund that the store does not honour, contact us.
- Price changes. If we change the price of a plan, the store notifies you before it applies to your next renewal, and where the store's rules require it, asks for your consent. If you do not agree, cancel before the renewal.
- Free features. We may change which features are free and which require Premium, and may offer trials or promotions on terms we set at the time.
Your payment details are held by Apple or Google. Fitzz never receives your card or bank details.
↑ Contents7. Acceptable use
You agree not to:
- use Fitzz for anything unlawful, or in a way that harms Fitzz, other users or third parties;
- copy, sell, rent, sublicense, distribute or commercially exploit the app, its content or its exercise videos, or use them to build or train a competing product or dataset;
- reverse engineer, decompile or attempt to extract the source code of the app or its services, except where the law expressly allows it;
- bypass or interfere with security, subscription or access controls, or access another person's account or data;
- overload, probe or disrupt our servers, or use automated means to access Fitzz other than through the app;
- remove or alter any copyright, trademark or other notice;
- submit feedback or content that is unlawful, abusive, or infringes someone else's rights.
8. Intellectual property
The Fitzz app, website, software, design, text, graphics, exercise programs, exercise descriptions and demonstration videos, the Fitzz name, logo and brand, and all other content we provide are owned by Fitzz or our licensors and are protected by copyright, trademark and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app and its content on a device you own or control, for your personal training, in accordance with these Terms. All other rights are reserved.
Your own training data (the workouts, sets and measurements you enter) remains yours. You can export or delete it as described in the Privacy Policy.
↑ Contents9. Content you submit
If you send us feedback, suggestions, bug reports, custom workouts or other material, you keep any rights you have in it, and you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, adapt and incorporate it into Fitzz without any obligation to you. You confirm that you have the right to grant this licence and that the material does not infringe anyone's rights. We are not obliged to use or keep anything you submit.
↑ Contents10. Third-party services
Fitzz depends on services run by others: Apple and Google (sign-in, app distribution, payments and push notifications), RevenueCat (subscription records), Supabase (database and authentication), Google Firebase (notifications, and analytics and crash reports according to your privacy settings) and Resend (email). Their availability is outside our control and their own terms govern your relationship with them. Fitzz may also contain links to third-party sites or apps; we are not responsible for their content or practices.
↑ Contents11. Changes to Fitzz and to these terms
To Fitzz. We are continuously improving the app and may add, change, suspend or remove features, programs, exercises and content at any time. We may release updates and may stop supporting older versions of the app or of your operating system; you may need to install updates to keep using Fitzz. If we discontinue Fitzz altogether, we will give reasonable notice in the app or by email, and any prepaid period you lose is refunded through the store where the law or the store's rules require it.
To these Terms. We may change these Terms. When we do, we publish the new version at fitzzapp.com with a new effective date, and for material changes we notify you in the app or by email at least 30 days before they take effect. If you do not agree with a change, stop using Fitzz and cancel any subscription before the change takes effect; continuing to use Fitzz after that date means you accept the new Terms. Changes do not apply retroactively.
↑ Contents12. Disclaimer of warranties
Fitzz is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that Fitzz will be uninterrupted, error-free or secure, that its content is accurate or complete, that any workout is suitable for you, or that you will achieve any particular result. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
↑ Contents13. Limitation of liability
To the fullest extent permitted by law, Fitzz is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or in connection with your use of, or inability to use, Fitzz, however caused. To the same extent, our total liability to you for all claims arising out of or relating to Fitzz or these Terms is limited to the greater of the amount you paid for Fitzz Premium in the twelve months before the event giving rise to the claim and 50 euros.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or any liability owed to you as a consumer that your local law does not allow us to limit.
↑ Contents14. Your responsibility for misuse
If your breach of these Terms, your misuse of Fitzz or your violation of a third party's rights leads to a claim against us, you agree to compensate us for the resulting losses, costs and reasonable legal fees, to the extent permitted by the law that applies to you. If you are a consumer, this section applies only to losses caused by your intentional or negligent breach.
↑ Contents15. Ending the agreement
You can end this agreement at any time by deleting your account (section 5). We may suspend or terminate your account if you breach these Terms, if we are required to by law, or if we discontinue Fitzz, and we will tell you why unless the law prevents it. Ending the agreement does not by itself cancel a subscription; cancel it in the store (section 6). Sections 8, 9, 12, 13, 14, 16 and 17 survive termination.
↑ Contents16. Disputes
If you are a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in the courts of that country. Consumers in the EU can use the European Commission's online dispute resolution platform; we are not obliged to take part in alternative dispute resolution unless the law requires it.
If any part of these Terms is found invalid, the rest remains in force. Our failure to enforce a right is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us about Fitzz. You may not transfer this agreement; we may transfer it to a successor operator of Fitzz who assumes our obligations.
↑ Contents17. Terms required by Apple and Google
If you use Fitzz on an Apple device, the following also applies, as required by Apple's App Store rules:
- Acknowledgement. These Terms are between you and Fitzz only, not Apple. Apple is not responsible for the app or its content. Your licence is limited to a non-transferable licence to use the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. Fitzz, not Apple, is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
- Warranty. Fitzz is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Fitzz's sole responsibility.
- Product claims. Fitzz, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
- Intellectual property claims. If a third party claims that the app or your use of it infringes their intellectual property rights, Fitzz, not Apple, is solely responsible for the investigation, defence, settlement and discharge of the claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties. You agree to comply with all applicable third-party terms when using the app.
- Developer contact. Questions, complaints and claims about the app go to Fitzz at the address in section 18.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
If you use Fitzz on an Android device, your purchase and use of the app through Google Play are also subject to the Google Play Terms of Service, and Google is not a party to these Terms and not responsible for the app.
